By accessing our website, purchasing services, submitting information, creating a profile, participating in the Phone Pal Program, subscribing to publications, or otherwise using any BATB service, you agree to be bound by these Terms of Service.

 

If you do not agree to these Terms, do not use our website or services.

1. ABOUT BACK AGAINST THE BARS

Back Against The Bars, LLC provides services designed to support incarcerated individuals, formerly incarcerated individuals, and their families through advocacy support, informational resources, communication programs, publications, and related services.

Services may include but are not limited to:

  • Phone Pal Connections
  • Inmate Profiles
  • Family Support Resources
  • The Bar Street Journal
  • Educational Materials
  • Legal Information Resources
  • Advocacy Support
  • Reentry Resources
  • Community Outreach Programs
  • Subscription Services
  • Marketing and Promotional Services
  • Digital and Printed Publications

BATB reserves the right to modify, discontinue, add, suspend, or remove any service at any time without notice.

2. NO ATTORNEY-CLIENT RELATIONSHIP

BATB is not a law firm.

Unless expressly stated in a separate written agreement with a licensed attorney, no attorney-client relationship exists between BATB and any user.

BATB does not provide:

  • Legal representation
  • Legal advice
  • Legal opinions
  • Court-appointed services
  • Government services

Information provided by BATB is for educational and informational purposes only.

Users are solely responsible for consulting qualified legal counsel regarding their specific legal matters.

BATB makes no guarantees regarding:

  • Sentence reductions
  • Appeals
  • Habeas petitions
  • Resentencing motions
  • Parole decisions
  • Commutation requests
  • Clemency petitions
  • Court rulings

Past results do not guarantee future outcomes.

3. ELIGIBILITY

You must be at least eighteen (18) years old to use BATB services.

By using BATB services, you represent and warrant that:

  • You are at least 18 years old.
  • Information provided is accurate.
  • You have authority to act on behalf of any incarcerated individual you represent.
  • Your use of the services does not violate any law or correctional institution rule.

4. PHONE PAL PROGRAM

BATB operates a Phone Pal Program designed to facilitate introductions between incarcerated individuals and non-incarcerated participants.

BATB does not guarantee:

  • Compatibility
  • Friendship
  • Romantic relationships
  • Ongoing communication
  • Frequency of contacts
  • Number of requests received

Participants acknowledge:

  • All participation is voluntary.
  • Communications occur at their own risk.
  • BATB does not control conversations.
  • BATB is not responsible for statements made by participants.
  • BATB does not monitor all communications.

BATB reserves the right to remove any participant from the Phone Pal Program at any time for any reason.

5. INMATE PROFILES

Inmate profiles may be created by:

  • The inmate
  • Family members
  • Friends
  • Authorized representatives

BATB does not independently verify every statement contained in profiles.

Information submitted by users remains the responsibility of the submitting party.

BATB may remove any profile at its sole discretion.

Users agree not to submit:

  • False information
  • Fraudulent information
  • Copyrighted material without authorization
  • Obscene material
  • Threatening material
  • Harassing material
  • Illegal content
  • AI Generated Images or Information

6. USER CONTENT

Users may submit:

  • Photographs
  • Biographies
  • Testimonials
  • Articles
  • Artwork
  • Poetry
  • Stories
  • Comments

By submitting content, you grant BATB a perpetual, royalty-free, worldwide license to:

  • Publish
  • Display
  • Reproduce
  • Distribute
  • Promote
  • Archive

such content in connection with BATB services.

Users retain ownership of their original content.

7. THE BAR STREET JOURNAL

BATB publishes The Bar Street Journal and related publications.

Articles, legal summaries, opinions, editorials, advertisements, and user submissions are provided for informational purposes only.

Nothing contained in any BATB publication shall be construed as legal advice.

BATB reserves editorial discretion regarding all submissions.

Submission does not guarantee publication.

8. PAYMENTS

Users agree to pay all fees associated with services purchased through BATB.

Fees may include:

  • Profile services
  • Subscription fees
  • Publication fees
  • Phone Pal services
  • Advertising services
  • Administrative fees
  • Processing fees

Prices may change without notice.

Failure to pay may result in suspension or termination of services.

9. NO REFUND POLICY

Due to administrative costs, labor, preparation time, publication expenses, profile setup costs, marketing expenses, and other operational expenses:

  • ALL SALES ARE FINAL.
  • NO REFUNDS SHALL BE ISSUED ONCE SERVICES HAVE COMMENCED.

This includes:

  • Legal support packages
  • Phone Pal services
  • Profile listings
  • Advertising purchases
  • Publication purchases
  • Subscription purchases
  • Administrative services

Exceptions may be granted solely at BATB's discretion.

10. PROHIBITED CONDUCT

Users agree not to:

  • Provide false information
  • Impersonate others
  • Harass users
  • Threaten users
  • Commit fraud
  • Promote criminal activity
  • Circumvent correctional facility rules
  • Violate intellectual property rights
  • Distribute malware
  • Attempt unauthorized access to BATB systems

BATB may terminate accounts immediately for violations.

11. ASSUMPTION OF RISK

Communicating with incarcerated individuals involves inherent risks.

By participating in BATB services, users acknowledge that:

  • BATB does not guarantee safety.
  • BATB does not guarantee truthfulness of user statements.
  • BATB does not conduct comprehensive background investigations.
  • BATB cannot predict user behavior.

Users assume full responsibility for their interactions.

12. DISCLAIMERS

BATB provides all services "AS IS" and "AS AVAILABLE."

BATB makes no warranties regarding:

  • Availability
  • Reliability
  • Accuracy
  • Results
  • Outcomes

BATB expressly disclaims all implied warranties to the fullest extent permitted by law.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, BATB shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Lost profits
  • Emotional distress
  • Lost opportunities
  • Data loss

BATB's total liability shall not exceed the amount paid by the user during the twelve (12) months preceding the claim.

14. INDEMNIFICATION

Users agree to indemnify, defend, and hold harmless Back Against The Bars, LLC, its owners, officers, employees, contractors, volunteers, affiliates, and agents from any claims, damages, liabilities, costs, or expenses arising from:

  • User conduct
  • User content
  • Violations of these Terms
  • Violations of law
  • Communications between users

15. INTELLECTUAL PROPERTY

All BATB branding, logos, publications, website content, graphics, and materials are the property of Back Against The Bars, LLC unless otherwise noted.

No material may be reproduced without written permission.

16. TERMINATION

BATB may suspend or terminate access to services at any time for any reason.

Users may discontinue use at any time.

Termination shall not affect any obligations incurred before termination.

17. DISPUTE RESOLUTION

Before filing any lawsuit, users agree to provide BATB written notice of any dispute and allow thirty (30) days to attempt informal resolution.

18. GOVERNING LAW AND VENUE

These Terms shall be governed by the laws of the State of Michigan.

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Wayne County, Michigan.

Users consent to personal jurisdiction in Michigan.

19. CLASS ACTION WAIVER

Users agree that disputes shall be brought solely on an individual basis.

No class actions, collective actions, or representative actions shall be permitted.

20. CHANGES TO TERMS

BATB may modify these Terms at any time.

Updated Terms shall become effective immediately upon posting to the website.

Continued use of BATB services constitutes acceptance of any revisions.
